Terms of Service

These Terms of Service govern the use of hosting, server, domain, infrastructure, technical support and related digital services provided by Datafex Bilişim Teknolojileri Ticaret Ltd. Şti.
By placing an order, creating a customer account or using any Datafex service through www.datafex.com.tr, each individual or legal entity confirms that they have read, understood and accepted these Terms of Service.
1. Parties

Any individual or legal entity that creates an account, places an order, makes a payment or uses Datafex services through www.datafex.com.tr.
In these Terms, Datafex Bilişim Teknolojileri Ticaret Ltd. Şti. shall be referred to as “Datafex”, and the person or entity receiving the service shall be referred to as the “Customer”.
2. Scope of the Agreement
These Terms define the scope of Datafex services, service usage rules, payment terms, customer responsibilities, prohibited uses, support scope, backup and data policies, resource usage limits and the rights and obligations of the parties.
These Terms may apply to the following services:
- Web hosting services
- Reseller hosting services
- Virtual server services
- Dedicated server services
- Domain registration and management services
- Colocation and infrastructure services
- Technical support services
- Other digital services provided by Datafex
3. Effective Date and Service Term
These Terms become effective when the Customer places an order and pays the relevant service fee using one of the payment methods accepted by Datafex.
The service term is determined according to the billing period selected during the order process. Services may be purchased monthly, annually or for other periods offered by Datafex.
If the service is not renewed at the end of the service term, it may expire, be suspended or be deleted.
4. Customer Information and Communication
The Customer confirms that all information provided during registration and order placement is accurate, current and complete.
The Customer is responsible for the accuracy of the following information:
- Full name or company name
- Email address
- Phone number
- Billing address
- Tax information
- Authorized contact details
- Technical information related to service use
Datafex may send notices to the Customer through the registered email address, customer panel, support system or other communication channels. The Customer is responsible for any delays, service interruptions, missed notices or loss of rights resulting from outdated or incorrect contact information.
The Customer must update their contact information through the customer panel whenever any changes occur.
5. Payment Terms
Unless expressly stated otherwise, Datafex services are provided on a prepaid basis.
The ordered service may not be activated until the payment is approved by Datafex. For bank transfer payments, service activation is completed after the payment reaches Datafex’s bank account and is verified.
For urgent activations, online payment methods are recommended. Datafex is not responsible for activation delays caused by bank transfer processing times, missing payment descriptions or banking delays.
6. Late Payment, Suspension and Deletion
The Customer is responsible for paying renewal fees by the due date.
If payment is not made by the due date, Datafex may apply one or more of the following measures:
- Temporary suspension of the service
- Restriction of access to the service
- Warning through the customer panel
- Permanent termination after a certain period
- Deletion of service-related data
If payment is not made within 7 days after the due date, the service may be permanently deleted. After this period, the Customer may not be able to request delivery of service data or backups.
Datafex is not responsible for data loss, access interruption, revenue loss or similar damages caused by suspension or deletion due to non-payment.
7. Payment Provider Fees
Banks, payment institutions or third-party payment providers may charge commissions, transaction fees or service fees for payment transactions.
Such fees may be reflected on the invoice during checkout. In case of a refund, commissions charged by payment providers may not be refunded.
Datafex is not responsible for fees, commissions or deductions applied by third-party payment providers.
8. Cancellations and Refunds
Cancellation and refund requests are evaluated based on the type of service, usage status, activation status and applicable law.
Refunds may not be available for domain registrations, licenses, custom installations, personalized or company-specific configurations, activated digital services and services that have generated third-party costs.
Refund conditions are applied in accordance with Datafex’s separately published Refund Policy and relevant service descriptions.
9. Backup Policy
The Customer is responsible for backing up all data, files, databases, emails, software, content and configurations hosted on Datafex services.
Datafex may provide automatic or periodic backups for certain services. However, such backups are provided as an additional safety measure and do not remove the Customer’s responsibility to maintain their own backups.
Datafex does not guarantee:
- That backups exist for every service
- That backups belong to a specific date
- That backups are complete
- That backups are restorable
- That backups will be provided in every case
The Customer must maintain regular external backups to prevent data loss.
10. Backup Delivery and Data Recovery
Datafex may provide an available backup or perform restoration if technically possible and permitted under its service policies.
The Customer may not request a backup from a specific date. Datafex may only provide backups that are available in its systems.
Providing backups for unpaid, expired, suspended or deleted services is at Datafex’s discretion.
For services suspended due to illegal use, abuse, spam, phishing, malware, attack tools or similar reasons, Datafex reserves the right not to provide backups. If necessary, backups may be reviewed, restricted or shared with authorized authorities.
11. Service Usage Responsibility
The Customer must use Datafex services in compliance with the law, public order, third-party rights and these Terms.
The Customer is responsible for their own account, services, passwords, access credentials, software, content and user activities.
The Customer may not hold Datafex responsible for damages arising from:
- Incorrect configuration
- Use of insecure software
- Outdated scripts, themes, plugins or modules
- Weak passwords
- Customer-caused security incidents
- Failure of third-party software
- Use of unlicensed or incompatible software
- Deletion, migration or modification actions performed by the Customer
12. Software Compatibility and Server Configurations
Shared hosting and reseller hosting servers are configured according to general usage requirements.
Datafex is not required to install custom software, change existing system settings or apply server-wide custom configurations upon Customer request.
The Customer must check whether any script, theme, module, plugin or custom software they intend to use is compatible with Datafex infrastructure before purchasing the service.
Datafex is not responsible for issues caused by third-party software failures, missing requirements, license problems or incompatibility.
13. Support Scope
Unless otherwise stated, Datafex services are provided under a self-managed support model.
Support requests must be submitted through the customer panel or official support channels determined by Datafex.
Datafex support generally covers:
- Service access issues
- Technical problems caused by Datafex infrastructure
- Basic checks related to panel, network or server access
- Billing and payment processes
- Service activation and renewal operations
The following services may be outside the support scope or may be offered as paid services:
- Customer software development
- Fixing script, theme, plugin or module errors
- Website migration
- Data recovery
- Security cleanup
- Custom optimization
- Custom installation and configuration
- Third-party application support
Datafex reserves the right to refuse support for issues not caused by Datafex or to offer paid support.
14. Data Migration
During the initial service purchase, Datafex may provide free or promotional data migration support if deemed appropriate.
Migration, transfer, backup import or custom data transfer operations outside the initial migration may be subject to additional fees.
The Customer is responsible for providing accurate and complete access information required for migration. Datafex is not responsible for delays caused by missing, incorrect or restricted access credentials.
15. Resource Usage and Fair Use
Datafex services are subject to resource usage limits to provide stable, secure and sustainable service to all customers.
For shared hosting and reseller hosting services, Datafex may limit CPU, RAM, disk I/O, inode count, email sending limits, process count and similar resources.
If an account on a shared server reaches a level of CPU or RAM usage that affects server stability, the account may be temporarily suspended, limited or required to move to a more suitable service package.
Resource usage violations may be detected automatically by the system and restrictions may be applied without prior notice. These measures are taken to protect service quality for other customers.
16. Prohibited Uses
The Customer may not use Datafex services for the following purposes:
- Hosting or distributing illegal content
- Hosting content that infringes copyrights
- Sharing warez, cracks, license bypass tools or pirated software
- Conducting phishing, fraud or identity theft activities
- Sending spam emails
- Hosting malware, viruses, trojans, botnets or similar software
- Hosting attack tools, exploits, scanners, mail bombers or abusive proxy tools
- Conducting unauthorized access, attacks, port scanning or denial-of-service activities
- Violating the security of other systems
- Hosting content that promotes hate speech, threats, harassment or violence
- Hosting any content involving child exploitation or endangering children
- Hosting obscene or unlawful content prohibited by applicable law
- Using the service as file storage, archive, CDN or sharing platform outside its intended purpose
- Consuming server resources in a way that prevents other customers from receiving service
If such use is detected, Datafex may suspend or terminate the service, review related data, refuse backup delivery and share necessary information with authorized authorities where required.
17. Shared Hosting Usage Rules
Shared hosting and reseller hosting services are provided for website hosting purposes. These services may not be used for:
- File storage or file sharing services
- Backup storage
- Video, music or media archives
- Game servers
- Proxy, VPN or tunneling services
- Bulk email systems
- Cryptocurrency mining
- Bots, crawlers or continuously running background applications
- Resource-intensive automation systems
The PHP mail function may be disabled on shared hosting servers. Email sending must be performed through SMTP. The Customer may not request activation of the PHP mail function.
18. Spam and Email Usage
Datafex services may not be used for spam, unsolicited bulk email, phishing or misleading email activities.
Services involved in spam or phishing may be suspended or permanently terminated without prior notice.
The Customer is responsible for blacklisting, IP reputation damage, third-party penalties, service interruption or financial damages caused by spam activities.
19. Content Responsibility
Datafex does not own and is not required to pre-monitor content hosted by the Customer.
The Customer is responsible for all content, files, software, data, email traffic and user activity hosted under their account.
Upon receiving notices from authorities, right holders or third parties regarding unlawful content, Datafex may suspend the relevant service, restrict access to the content or take necessary action.
20. Security and Abuse
The Customer is responsible for securely protecting usernames, passwords, API keys, panel access and other authentication credentials related to their services.
Actions performed through the Customer’s account are deemed to have been performed by the Customer unless proven otherwise.
In case of a security risk, attack, unauthorized access, excessive resource usage, network disruption or suspected abuse, Datafex may temporarily restrict or suspend the service.
21. Insults, Threats and Abuse
The Customer may not insult, threaten, harass, abuse, degrade or use offensive language against Datafex employees, representatives, business partners or other customers through support tickets, email, phone, live chat or other communication channels.
If such behavior is detected, Datafex may restrict support, limit communication channels, suspend the service or terminate the agreement.
The Customer’s right to criticism and complaint is reserved. However, unlawful threats, defamation, personal attacks, smear campaigns or abusive conduct are not covered by this right.
22. Announcements and Notices
Datafex may announce maintenance, outages, service changes, price updates, security warnings or important notices through its website, customer panel, email or other communication channels.
The Customer is responsible for following announcements and notices related to their services.
23. Data Usage and Bandwidth Overuse Policy
For certain virtual server, dedicated server or hosting services, bandwidth usage may be calculated using the Perc95 method.
The Perc95 calculation method is based on traffic measurements taken at 5-minute intervals, sorted at the end of the month, with the highest 5% of usage excluded. The 95th percentile value is then calculated from the remaining usage data.
Unless otherwise specified in the relevant service description, the Perc95 bandwidth overuse threshold for a virtual server service is accepted as 25 Mbit/s.
If the Customer’s Perc95 value exceeds the defined limit, one or more of the following measures may be applied:
- For services billed in Turkish lira, a monthly overuse fee of 30 TRY + VAT for each 1 Mbps of overuse
- For services billed in US dollars, a monthly overuse fee of 1 USD for each 1 Mbps of overuse
- For services billed in euros, a monthly overuse fee of 1 EUR for each 1 Mbps of overuse
- Limiting the traffic speed to the applicable service limit
- Offering a more suitable package, dedicated bandwidth option or custom traffic agreement
Bandwidth overuse fees are charged in the currency in which the relevant service is billed. If the service is billed in a different currency, Datafex reserves the right to determine an equivalent fee by taking into account current exchange rates, payment provider fees and operational costs.
Where possible, Datafex will notify the Customer in writing when bandwidth overuse is detected. However, in cases involving network security, service continuity, excessive usage or the protection of service quality for other customers, speed limitation may be applied without prior notice.
The Customer may access data usage reports through the customer panel. If the Customer believes that the usage records are inaccurate, they may submit a written objection to Datafex within 15 days.
Planned maintenance, attack traffic or extraordinary circumstances may be evaluated differently by Datafex in the Perc95 calculation.
24. Service Interruptions and Maintenance
Datafex may perform planned or emergency maintenance to maintain service quality and security.
Planned maintenance is announced in advance where possible. However, in cases requiring urgent action due to security, network integrity, attacks, hardware failures or similar reasons, maintenance may be performed without prior notice.
Datafex is not responsible for interruptions caused by internet infrastructure, third-party services, data centers, electricity, network problems, natural disasters, attacks, force majeure events or Customer-related issues.
25. Third-Party Services
Datafex may work with third-party service providers to deliver certain services. These may include payment providers, domain registrars, data center providers, license providers, security services and communication providers.
Datafex is not directly responsible for delays, interruptions, price changes, policy changes or technical issues caused by third-party services.
26. Price and Service Changes
Datafex may update service prices, package contents, technical specifications and usage terms from time to time.
For existing paid service periods, changes are applied from the renewal period where possible. However, changes may be applied earlier when required due to legal obligations, security concerns, infrastructure costs, abuse prevention or third-party provider changes.
By continuing to use the service, the Customer is deemed to have accepted the updated terms.
27. Suspension and Termination
Datafex may suspend the service or terminate the agreement in the following cases:
- Non-payment
- Breach of these Terms
- Illegal use
- Spam, phishing or malicious activity
- Excessive resource usage
- Creation of security risks
- Providing false or misleading customer information
- Threats, insults or abuse against Datafex employees
- Requests from authorized authorities
If the agreement is terminated, the Customer’s unpaid debts, past usage responsibilities and legal obligations continue to apply.
28. Limitation of Liability
Datafex makes reasonable efforts to provide its services with due care and technical competence. However, no service is guaranteed to be uninterrupted, error-free or completely secure.
Datafex is not responsible for:
- Data loss
- Loss of revenue or profit
- Business interruption
- Loss of reputation
- Third-party service interruptions
- Customer software or configuration errors
- Unauthorized access or security incidents
- Force majeure events
- Damages caused by the Customer’s breach of these Terms
If Datafex is held liable for any reason, its liability shall be limited to the amount paid by the Customer for the relevant service during the most recent billing period.
29. Force Majeure
Natural disasters, war, terrorism, cyberattacks, power outages, internet backbone issues, data center failures, strikes, government decisions, legal changes, epidemics and events beyond Datafex’s reasonable control are considered force majeure.
In force majeure situations, Datafex shall not be responsible for delayed or incomplete performance of its obligations.
30. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye.
Istanbul Courts and Enforcement Offices shall have jurisdiction over any disputes arising from these Terms.
31. Effectiveness
By placing an order, making a payment, creating a customer account or using Datafex services through www.datafex.com.tr, the Customer is deemed to have accepted these Terms of Service.
Datafex may update these Terms at any time. The updated version becomes effective once published on www.datafex.com.tr.
